Claims process
Arbitration
Arbitration is a private dispute process in which an arbitrator issues a decision instead of a judge or jury, and it is usually binding and difficult to appeal.
It commonly arises from a clause signed long before the injury — in a nursing home admission agreement, an employment contract or a rideshare terms of service.
Whether a clause is enforceable is itself frequently litigated, and that fight can take months before the underlying claim is reached.
