2026

What changed this year

Three material changes landed in the first half of 2026. If you are reading an article about funding law written before this year, assume it is out of date.

Banned outright

North Carolina

HB 315, the Prohibit Litigation Investments Act, signed June 22, 2026 and effective immediately. The first outright state ban on third-party litigation financing in the country.

Now regulated

New York

The Consumer Litigation Funding Act (A804C / S1104A) took effect June 17, 2026, introducing registration, disclosure and conduct rules for consumer legal funding in the state.

Registration required

Georgia

SB 69, effective January 1, 2026. Funders must register with the Department of Banking and Finance through NMLS and meet disclosure requirements, and on advances of $25,000 or more the funding agreement is discoverable in the case.

“PI deadline” is the ordinary personal injury statute of limitations and has exceptions — claims involving minors, government defendants and injuries discovered late all run differently. Workers’ compensation runs on a separate and usually shorter clock. General information, not legal advice.
