Comparison

What is the difference between pre-settlement and post-settlement funding?

Pre-settlement funding is an advance while your case is still open and the outcome is unknown; post-settlement funding is an advance after your case has resolved but before the money has been disbursed. Post-settlement costs less — 15% per six-month period against 25% — because the risk is lower.

Post-settlement advances are also repaid much faster. Half are returned within 66 days, against 171 days for pre-settlement, because the money is already coming and the only question is when the check clears the process.

The waiting period after settlement surprises most people. Lien negotiation, insurer processing and trust account rules routinely mean weeks or months between agreeing on a number and receiving it.

Both are non-recourse. Even after a case has settled, if the recovery does not arrive, you owe nothing.
