Does the defendant find out?
Usually not, but it depends on the state. Get Lit Money does not notify the defendant or their insurer, and in most states funding is not disclosed. Some states now make funder involvement discoverable in litigation — Georgia's SB 69 is one example — which means the other side could learn of it through discovery.
This is a growing area of change. Several states and some federal courts have moved toward requiring disclosure of third-party litigation funding, and the trend is toward more disclosure rather than less.
Where it is discoverable, it is generally the existence of the agreement that is disclosable rather than your financial circumstances.
Ask your attorney what applies in your jurisdiction. If disclosure is a concern for your case, it is worth knowing before you sign rather than after.
