Settlement

What is a medical lien?

A medical lien is a claim on your settlement held by a healthcare provider, health insurer or government program that paid for your treatment. It is repaid out of the settlement before you receive your share.

Liens come from several places: providers who treated you on a letter of protection, your health insurer exercising subrogation rights, and Medicare or Medicaid, which have statutory recovery rights that cannot be ignored.

Lien amounts are frequently negotiable and your attorney will usually reduce them. This is one of the most valuable things a good firm does, and it can add thousands to your net recovery.

Stacked liens are also the most common reason a funding application is declined — if providers, an insurer and a prior funder already hold claims on the case, there may be nothing left to advance against.
