Settlement

Why is my settlement taking so long?

The most common reasons are that your medical treatment is not finished, that liability is disputed, that the insurer is deliberately slow, or that the case has entered litigation. Attorneys generally will not settle before you reach maximum medical improvement, because settling earlier means guessing at the cost of care you have not had yet.

Maximum medical improvement is the point at which your condition has stabilized. Until then nobody knows what the case is worth, and settling early usually means settling low.

Delay is also a tactic. Insurers understand that an injured claimant with no income becomes more willing to accept less over time, and some of the delay you are experiencing is that strategy working as intended.

That is precisely what an advance is for — removing the financial pressure that makes a low offer look acceptable.

Ask your attorney where the case actually is. Most people waiting have not been given a straight answer, and firms will usually give one if asked directly.
